SafeUT App Terms of Use

By using this application, which is operated by the University of Utah, a body politic and corporate of the State of Utah (the “Operator”), you agree to the following terms of use. If you do not agree to all of these terms of use, please do not use this application. The Operator may revise and update these Terms of Use from time to time without notice. Your continued use of this application means you accept those changes.

Crisis Counseling

This application is intended for use, and only supported, within the State of Utah. If you are seeking crisis counseling or resources outside of the State of Utah, you may also contact the National Suicide Prevention Lifeline at 1-800-273-8255 or visit https://suicidepreventionlifeline.org.

 

Emergencies

Do not use this application to report emergencies. IF YOU, OR SOMEONE YOU KNOW, IS IN DANGER OR EXPERIENCING A MEDICAL EMERGENCY, PLEASE DIAL 911. The Operator does not guarantee or assume any responsibility for if, how, or when any submitted information may be reviewed or acted upon by law enforcement, school officials, or public safety officials.

 

Use of Submitted Information

Information you submit through this application, including without limitation geolocation data, may be reported to law enforcement, school officials, or public safety officials if disclosure is necessary to protect the health and safety of any individuals, or as needed in the event of an emergency or to assist a law enforcement investigation. In furtherance of its academic and research missions, the Operator may use data collected by this application for research purposes in accordance with its institutional policies.

 

Access to Submitted Information

An ID and password will be issued to you when you participate in a chat session with a crisis counselor. You can access the transcript of your chat session through the “View Existing Chats and Tips” area of this application on your device or entering in your id and password into this application from another device.

 

Disclaimer

The Operator and any of their employees or agents are not responsible for any decisions or results of the decisions that you make. You assume all risk for use of this application. By using this application you agree to hold the Operator harmless for damages arising out of information provided through this application.

 

The information provided through this application are given “as is”. To the maximum extent permitted by applicable law, the Operator disclaims all representations and warranties, expressed or implied, with respect to such information, services, products, and materials, including without limitation any implied warranties or merchantability, fitness for a particular purpose and noninfringement. In no event will the Operator be liable for any consequential, indirect, incidental, special, or punitive damages, however caused and under any theory of liability (including negligence), arising from your use of this application or the provision of the information, services, products, and materials provided to or by the Operator, even if the Operator has been advised of the possibility of such damages.

 

Security

Although the Operator has put in place appropriate physical, electronic, and managerial procedures to safeguard information submitted through this application, due to the nature of the internet and SMS delivery networks, the Operator does not guarantee 100% security or timely delivery or reception of information you submit.

 

Improper Use

The information that you provided on this form must be correct to the best of your knowledge. The deliberate provision of false information may be investigated and/or subject you to disciplinary action in accordance with your applicable student code. Any misuse or abuse of this application is strictly prohibited. The Operator may suspend or terminate your access to this application at any time, including if the Operator reasonably suspects improper use.

 

Intellectual Property

The content contained in this application is secured by relevant copyright and trademark law and is the property of the Operator. You may not (i) modify, copy, distribute, transfer, or create derivative works of the content; (ii) use the content for any commercial use, or for any public presentation (business or non-business) without our written consent; (iii) attempt to decompile or rebuild any content contained in this application; or (iv) remove any copyright or other restrictive documentations from the content.
